The use of the Company's Websites, Phone Sales and Retail Establishments is governed by the Terms and Conditions set forth below. By using the Company's Website, Products, Facilities and Service Outlets, you agree to these terms of use. If you do not agree to these terms of use, you may not use these resources. We reserve the right to modify, alter or update these Terms of Use, and you agree to be bound by such modifications, alterations and updates.


The Company

The term "the Company" refers to Darkhorse Wheel & Traction Corporation, a Texas Corporation doing business as "Motorcars Ltd", "Motorcars-LTD", "British Parts International", or Black Dog Manufacturing Company".


Typographical Errors

In the event a product is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, the Company shall have the right to refuse or cancel any orders placed for merchandise listed at the incorrect price. The Company shall have the right to refuse or cancel any such orders whether or not the order has been confirmed.


Copyright

Everything found at the Company's Websites is copyrighted unless otherwise noted, and may not be used except with the Company's express written consent. Use of our HTML, images, and or ideas and concepts by you or third parties for purposes other than those expressed or implied is strictly prohibited and may violate the copyright laws, trademark laws, privacy laws and other laws and regulations. Nothing contained in this site may be construed as granting any license or right to use any of our trademarks or service marks without prior written consent.


Trademarks

All trademarks, service marks and trade names (collectively called the "marks") that appear on our site are proprietary to the Company or other respective owners that have granted the Company the right and license to use such marks.

All information, services, products and materials contained in this site, including text, graphics and links are provided on an "as is" basis with no warranty. To the extent permitted by law, the Company disclaims all representations and warranties, expressed or implied, with respect to such information, services, products and materials particular purpose, title, non-infringement, freedom from computer virus, and implied warranties arising from course of dealing or course of performance. The Company does not represent or warrant that information accessible via this site is accurate, complete or current. Price and availability information is subject to change without notice.


Limitation of Liability

The Company will not be liable for any direct, indirect, special, punitive, incidental, exemplary, or consequential damages whatsoever, even if the Company has been previously advised of the possibility of such damages whether in an action under contract, negligence, or any other theory, arising out of or in connection with the use, inability to use, or performance of the information, services, products, and materials available from the Company's Website, Products, Facilities, and Service Outlets. These limitations will apply notwithstanding to any failure of essential purpose of any limited remedy. Because some jurisdictions do not allow limitations on how long an implied warranty lasts, or the exclusion or limitation of liability for consequential or incidental damages, the above limitations may not apply to you.


Private Policy Statement

The Company is committed to protecting our Customer's privacy. We will not collect any personal information from our Customer and sell, share or rent that information to others in any manner not mentioned in this statement. The Company is the sole owner of all information collected on its Websites, Facilities and Service Outlets.


Labor

The Company will not refund any labor costs incurred by the buyer or the installer of the products purchased at Company's website, Facilities and Service Outlets.


Sales Policies


Any parts sales are redirected from this site to our distributer sites, www.motorcars.com and britishparts.com in which case the terms and conditions on those sites applies.


Warranties


Remanufactured Parts Warranties

Remanufactured parts carry a 12 month warranty from invoice date with a "repair or replace" warranty - at the option of the Company.


Extended warranties and labor warranties may be purchased separately for an additional charge on selected remanufactured and salvaged parts. Please contact your salesperson for more information.


In the event of a part's failure, the Company specifically denies any liability for the damage to associated parts, consumables or the labor to replace such defective parts. No liability beyond replacement of goods is accepted or implied. No labor warranty expressed or implied.


Warranty covers manufacturing defects and does not cover improper installation or abuse.


Returns Policies

Remanufactured Parts Returns

Remanufactured parts carry a 30-day return policy from invoice date and are subject to a 15% restocking charge. after 30 days, a 25% restocking charge is charged. The 25% restocking charge may be reduced to 15% if the customer agrees to accept Store Credit in lieu of a refund.


All returned parts must be in saleable condition and in their original boxes. Dirty and greasy boxes are not returnable.


Parts that have been installed, plugged in or marked in any manner are not acceptable for return.


Electrical parts are not returnable.


A Return Authorization Number (RAN) must be obtained from customer service at 1-800-338-5238 ext. 129 prior to any return or it will be refused at our dock. All calls will be returned between 8:00am to 1:00pm the following business day.


Core Returns

Cores must be complete, fully assembled and in rebuildable condition in order to receive core credit. A box of parts does not constitute a rebuildable core. A part requiring welding does not constitute a rebuildable core.


Upon receipt, the Company will inspect the core and refund the core charge less whatever non-wear parts are broken, missing, or damaged. Cores requiring welding may be fixed at the customer's option in order to make the core "rebuildable". Charges for repairing a core are deducted from the core refund.


If the customer refuses to repair a core to make it rebuildable, the core will be returned to the customer, freight collect and no core refund will be made.


Cores must be returned within 90 days. after 90 days, a 25% late charge will be deducted from the core refund.


All cores must be returned in the original manufacturer's box.


Cores returned must be the same as the unit sold.


Ratios of differential units returned must be the same as the ratio sold.


The customer is responsible for the return of the core. The cores should be packed carefully for return in order to protect the core from shipping damage. The Company is not responsible for shipping damage.


Rejected cores will be returned to the customer freight collect and no core refund wil be given.


Partial core credit will NOT be given for partial or damaged cores. See above for terms of core repairs.
